In Kimber v. Thiokol Corp., 196 F.3d 1092, the U.S. Court of Appeals for the Tenth Circuit upheld a U.S. District Court's grant of summary judgment against an employee's claim that an employeroperated disability insurance plan, which offered different levels of compensation for disabilities due to mental and physical conditions, violated Title I of the Americans with Disabilities Act. The Court of Appeals found that the Thiokol plan administrator's interpretations of the plan were not arbitrary and capricious, and that the (...) plan's different treatment of disabilities caused by physical and mental conditions did not violate the ADA. ‘The day of the Lord is already here’ (2 Thess 2:2b) – A key problem to the understanding of the second letter to the Thessalonians. 2 Thessalonians 2:2b, that is, the words ἐνέστηκεν ἡ ἡμέρα τοῦ κυρίου are a crux interpretum. At the same time their interpretation is crucial for the overall understanding of 2 Thessalonians. Does this text offer a view of early Christian eschatology totally different from Paul’s or is it compatible to what we read for example in (...) 1 Thessalonians? The article deals critically with two recent monographs by Norbert Baumert and Maria-Irma Seewann who offered a new interpretation of the passage according to which 2 Thessalonians 2:2 is not concerned with matters of Parousia, but with Christ’s presence in the community. It offers an overview of the development of the ‘Day of the Lord’ traditions in the Old Testament and Early Judaism and shows that Baumert and Seewann’s interpretation is untenable. After an analysis of the context of 2 Thessalonians 2:1–2 the article develops an own interpretation of 2 Thessalonians’ 2:2 in light of a parallel in Hippolyt’s Commentary on Daniel. The eschatology of 2 Thessalonians 2 finally, provides an argument for the text’s pseudepigraphy. (shrink)

The “historical myths” addressed in the target article are but one type of societal meta-narrative, a cognitive framework for understanding the story of one's group: Its origins, purpose, turning points, threats and opportunities, key relationships, and the appropriate affect for group members. Engagement with the broader literature on meta-narratives, including political and sacred myths, and on group entitativity is recommended.

The performance and the success of a group working as a team on a common goal depends on the individuals’ skills and the collective coordination of their abilities. On a perceptual level, individual gaze behavior is reasonably well investigated. However, the coordination of visual skills in a team has been investigated only in laboratory studies and the practical examination and knowledge transfer to field studies or the applicability in real-life situations have so far been neglected. This is mainly due to (...) the fact that a methodological approach along with a suitable evaluation procedure to analyze the gaze coordination within a team in highly dynamic events outside the lab, is still missing. Thus, this study was conducted to develop a tool to investigate the coordinated gaze behavior within a team of three human beings acting with a common goal in a dynamic real-world scenario. This team was a basketball referee team adjudicating a game. Using mobile eye-tracking devices and an indigenously designed software tool for the simultaneous analysis of the gaze data of three participants, allowed, for the first time, the simultaneous investigation of the coordinated gaze behavior of three people in a highly dynamic setting. Overall, the study provides a new and innovative method to investigate the coordinated gaze behavior of a three-person team in specific tasks. This method is also applicable to investigate research questions about teams in dynamic real-world scenarios and get a deeper look at interactions and behavior patterns of human beings in group settings. Her insight into the reproductive biology of algae was the key to efficient farming of the seaweed “nori” which is a familiar component of Japanese food.

This is a brief response to ‘Do not despair about severity—yet’ by Barraet al. It argues that they have no serious criticisms of Daniel Hausman’s essay, ‘The Significance of Severity’” and that indeed their work lends further support to his view that there is no justification for prioritising severity. As policy-akers, Barra and his coauthors are more constrained by popular attitudes, which apparently favour prioritising severity.

Lyotard’s references to film and video are so limited, it should be relatively easy to expand his repertoire and consider his thoughts in relation to those of my own. But I have struggled, and skirted round my chosen topic for too long; how can his ideas be brought to play productively to my own ends – to consider the relationship of performance art to film? Perhaps that is the problem: I have sought a productive return on my investment, rather than (...) light that match simply to watch it burn. Listen to me, then, as I set fire to the skin of the film and confront the tangled mess of melted celluloid: after the performance. This article considers aspects of Marina Abramović in The Artist is Present (dir. Akers, 2012), Stuart Brisley’s performance in Ghost Dance (dir. Can we base the whole of logic solely on the concept of incompatibility? My motivation for asking this is two-fold: firstly, a technical interest in what a minimal foundations of logic might be; and secondly, the existence of philosophers who have taken incompatibility as the ultimate key to human reason (viz., e.g., Hegel's concept of determinate negation). The main aim of this contribution is to tackle two related questions: Is it possible to reduce the foundations of logic to the mere (...) concept of incompatibility? and Does this reduction lead us to a specific logical system? We conclude that the answers, respectively, are YES and a qualified NO (qualified in the sense that basing semantics on incompatibility does make some logical systems more natural than others, but without ruling out the alternatives.) A search for the bare bones of logic generally leads one to the relation of inference (or consequence). This way is explored meticulously by Koslow (1992). He defines an implication structure as, in effect, an ordered pair , where S is a set and | f Pow(S)HS fulfilling certain (relatively simple) restrictions. And obviously if we reduce incompatibility to inference, which is achievable by the well known ex contradictione quodlibet principle, we reach a logic based on incompatibility. The kind of logic flowing most straightforwardly from this setting is the intuitionist one. However, there is also the approach taken by R. Brandom and A. Aker (2008), who have set up a logic based directly on incompatibility. They define an incompatibility structure as an ordered pair such that S is a set and z f Pow(S) (again fulfilling certain restrictions). The authors introduce logical operators in such a way that they reach classical logic. Does this mean that inference 'naturally' leads to intuitionist logic, whereas incompatibility leads to the classical one? Myself, I have argued that it is indeed intuitionist logic that is the logic of inference (see Peregrin, 2008).. (shrink)

The assembly of a bipolar spindle is essential for the accurate segregation of replicated chromosomes during cell division. Do chromosomes rely solely on other cellular components to regulate the assembly of the bipolar spindle or are they masters of their own fate? In the Zhang and Nicklas(1) study reviewed here, micromanipulation techniques and video microscopy were used to demonstrate the different roles that chromosome arms, kinetochores and centrosomes play in bipolar spindle assembly.

This wonderful and remarkable book by Wang Fengyi (1864-1937) is a true testament to the benefits of Daoist spiritual cultivation. At age thirty-five, having become aware of the repercussions and implications of emotions on his own health condition, Wang attained the Dao and began spreading his teachings. One of his most remarkable accomplishments was the founding of countless schools for young women, making education accessible to them on a large scale. Wang Fengyi's teachings are like a thoughtful and insightful poetry (...) that can allow one to transform oneself, one's body and one's Spirit. If you seek to help others or bring wellness to yourself, these teachings can be enormously beneficial, offering direction and great insights for one's well-being. As Daoist practitioners, Johan Hausen and Jonas Akers have done an excellent job in translating this valuable treatise, bringing additional authenticity to the transmission of this work and propagation of Wang Fengyi's teachings. My goal is to define intending. I defend the view that believing and desiring something are necessary for intending it. They are not sufficient, however, for some things we both expect and want (e.g., the sun to rise tomorrow) are unintendable. Restricting the objects of intention to our own future actions is unwarranted and unhelpful. Rather, the belief involved in intending must be based on the desire in a certain way. En route, I argue that expected but unwanted consequences are (...) not intended, examine the two senses of "desire," distinguish intending from being willing, and relate intending to a variety of other propositional at? titudes. Upshot: The concept of “constructivist teaching” seems unattainable for two reasons: a philosophical and an empirical one. Also, Hugh Gash’s survey is not so much about radical constructivism in education, but a review of different connected ideas labeled “constructivism” that have dominated the educational field.

The work _De spiritu_ is an important but neglected work by Aristotle. It clearly shows for the first time that Aristotle assumed a special body as the ‘instrument’ of the soul. By means of this soul/body the soul forms the visible body of plants, animals and human beings.

In this paper we examine the functional anatomy of volition, as revealed by modern brain imaging techniques, in conjunction with neuropsychological data derived from human and non-human primates using other methodologies. A number of brain regions contribute to the performance of consciously chosen, or ‘willed', actions. Of particular importance is dorsolateral prefrontal cortex , together with those brain regions with which it is connected, via cortico-subcortical and cortico-cortical circuits. That aspect of free will which is concerned with the voluntary selection (...) of one action rather than another critically depends upon the normal functioning of DLPFC and associated brain regions. Disease, or dysfunction, of these circuits may be associated with a variety of disorders of volition: Parkinson's disease, ‘utilization’ behaviour, ‘alien’ and ‘phantom’ limbs, and delusions of ‘alien control’ . Brain imaging has allowed us to gain some access to the pathophysiology of these conditions in living patients. At a philosophical level, the distinction between ‘intentions to act', and ‘intentions in action’ may prove particularly helpful when addressing these complex disturbances of human cognition and conscious experience. The exercise and experience of free will depends upon neural mechanisms located in prefrontal cortex and associated brain systems. (shrink)
